A couple has filed a petition in the Calcutta High Court accusing an IVF center of fraud after DNA tests revealed that the child born through the IVF process was not their biological offspring. The couple, who had been struggling with infertility for several years, decided to undergo IVF treatment after multiple failed attempts. They contacted an IVF center in the city and, after two unsuccessful tries, succeeded in having a child in 2019 with the third IVF attempt.
In 2021, the couple's child was diagnosed with cancer, and doctors recommended a bone marrow transplant. During further medical examination, it was discovered that the child’s bone marrow did not match the parents, and DNA tests revealed no genetic relation to either parent. Upon contacting the IVF center, the parents were informed about the biological mother but were not given information regarding the biological father.
The couple then accused the IVF center of carrying out the procedure without their consent and alleged that their signatures on the consent form were forged. After the child passed away in 2023 due to complications from the failed bone marrow transplant, the parents filed a police complaint. They also approached the West Bengal Clinical Establishment Regulatory Commission (WBCRC), which found irregularities at the IVF center and ordered a compensation of five lakh rupees. However, the couple is seeking punishment for the IVF center, not compensation, and has requested the revocation of the center's license. The case is scheduled to be heard on Friday in the Calcutta High Court before Justice Amrita Sinha.
